These Terms of Service (“Terms”) govern your access to and use of the CareLink website, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Overview

CareLink is a technology platform that helps patients, healthcare professionals, and organizations coordinate care (for example: appointments, messaging, records, referrals, and related workflows).

If you are using the Services on behalf of an organization (such as a clinic, hospital, school, or employer), you represent that you are authorized to accept these Terms on that organization’s behalf.

2) Accounts & Eligibility

  • Accurate information: You agree to provide accurate, complete, and up-to-date information and to keep it updated.
  • Account security: You are responsible for safeguarding your credentials and for all activity under your account.
  • Eligibility: You must be legally able to enter into a binding contract in your jurisdiction. If you are using the Services for or with a minor, you represent that you have the authority to do so.

3) How CareLink Works

The Services may include (depending on your role and permissions): scheduling, secure communications, documentation tools (such as notes, vitals, labs, and prescriptions), and administrative dashboards.

Healthcare professionals and organizations using CareLink may have their own policies and professional obligations. CareLink does not control the clinical decisions, practices, or conduct of independent healthcare professionals.

4) Healthcare Disclaimer

If you think you may have a medical emergency, call your local emergency number immediately. Do not rely on CareLink for emergency services.

CareLink is not a medical provider and does not provide medical advice, diagnosis, or treatment. Any health information in the Services is for general informational purposes and is not a substitute for professional medical advice.

5) Acceptable Use

You agree not to:

  • Use the Services in a way that violates any applicable law or regulation.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Upload or transmit malware, or interfere with the security or integrity of the Services.
  • Misrepresent your identity, credentials, or affiliation.
  • Use the Services to harass, abuse, or harm any person, or to share unlawful or infringing content.

6) User Content & Messaging

The Services may allow you to submit content, including messages, files, and clinical documentation (“User Content”). You retain ownership of your User Content, but you grant CareLink a limited license to host, process, transmit, and display User Content as necessary to provide the Services.

You are responsible for your User Content and for ensuring that you have the necessary rights and permissions to submit it.

7) Fees & Payments

Some parts of the Services may be provided for a fee (for example: subscriptions, premium features, or organization plans). If fees apply, we will present the relevant terms before you incur charges.

Unless otherwise stated, fees are non-refundable to the extent permitted by law.

8) Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to our data practices as described there.

9) Intellectual Property

The Services, including software, designs, text, graphics, logos, and trademarks, are owned by CareLink or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.

10) Third-Party Services

The Services may integrate with third-party services (for example: messaging, analytics, identity providers, or payment processors). Your use of third-party services is governed by their terms and policies, and we are not responsible for their practices.

11) Suspension & Termination

We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms, created risk or potential legal exposure, or if we are required to do so by law.

You may stop using the Services at any time. If you want to delete your account, contact us as described below (subject to any retention obligations we may have).

12) Disclaimers

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, CareLink disclaims all warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

13) Limitation of Liability

To the maximum extent permitted by law, CareLink will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.

In no event will CareLink’s total liability for all claims exceed the amount you paid to CareLink for the Services in the 12 months before the event giving rise to the claim (or, if you have not paid anything, a reasonable amount determined by CareLink).

14) Indemnification

You agree to indemnify and hold harmless CareLink from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

15) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example: by posting an updated version and changing the “Last updated” date).

By continuing to use the Services after the effective date of an updated version, you agree to the updated Terms.
